Exchange of message on Social Media Platform in India

Social media Platforms like WhatsApp, Telegram and Facebook messenger or any other platforms where there is exchange of messages contains no evidentiary value in the eyes of law.

In July 2021, a bench of CJI N.V. Ramana, Justice A.S. Bopanna and Justice Hrikesh Roy observed that

“what is the essential value of WhatsApp messages these days? Anything can be created and deleted on social media these days. We don’t attach any value to the WhatsApp Messasge”.

 

This makes the relevancy of the evidential value of the whatsApp message as null.
